1. Agreement
By creating an account, installing W1, or using the service, you agree to these Terms and the Privacy Policy. “W1”, “we”, and “us” mean the W1 service operated by Nakai Williams in South Africa. If you use W1 for an organization, you confirm that you are authorized to accept these Terms for it.
If you are under the legal age required to enter a contract where you live, a parent or legal guardian must authorize your use.
2. Beta service
W1 is beta software. Features, limits, supported platforms, models, availability, and pricing may change. The beta may contain defects, produce incorrect output, lose non-critical state, or be temporarily unavailable. We will try to communicate material changes honestly, but the beta is not a guaranteed production service.
3. Accounts and access
You must provide accurate account information and protect access to your account and devices. Do not share session tokens or access credentials outside their intended use. Tell us promptly if you believe your account has been compromised.
We may apply fair-use limits, suspend abusive traffic, revoke compromised sessions, or end beta access when necessary to protect users, providers, or the service.
4. Your projects and content
You retain ownership of your source code, documents, prompts, and other content. You give W1 a limited permission to process that content only as needed to provide, secure, support, and improve the service under the Privacy Policy.
You are responsible for having the rights and permissions needed to submit content to W1. Do not submit secrets, personal data, confidential client material, or regulated information unless it is necessary, permitted, and appropriately protected.
5. Acceptable use
Do not use W1 to:
- Break the law, violate another person’s rights, or distribute malware.
- Access systems, accounts, or data without authorization.
- Evade safeguards, usage limits, or provider restrictions.
- Harass, exploit, deceive, or cause material harm.
- Submit content you do not have a right to process.
- Resell or automate access in a way that damages the beta or prevents others from using it.
6. AI output and local tools
AI output may be incomplete, outdated, insecure, or wrong. W1 can read and modify files and run local commands within the access you grant. You are responsible for reviewing important changes, maintaining backups or source control, testing the result, and deciding whether to deploy, publish, or rely on it.
Do not treat W1 output as professional legal, medical, financial, security, or other regulated advice. W1’s visible checks reduce risk but do not eliminate it.
7. Availability, updates, and third parties
W1 depends on operating-system stores, authentication, cloud, analytics, email, and model providers. Their availability and terms may affect the service. Install W1 only from the official W1 website, the Microsoft Store, Apple-notarized artifacts, or the official VS Code Marketplace listing.
W1 may install or offer signed updates. Keeping the application current is important for security, compatibility, and account access.
8. Disclaimers and responsibility
To the maximum extent allowed by law, the beta is provided “as is” and “as available” without warranties that it will be uninterrupted, error-free, secure, or suitable for a particular purpose. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
To the maximum extent allowed by law, W1 is not responsible for indirect, incidental, special, or consequential loss arising from use of the beta, including lost profits, data, opportunities, or business interruption. You remain responsible for backups, source control, review, and deployment decisions.
9. Changes and governing law
We may update these Terms as the beta develops. Material changes will be posted with a new effective date. Continued use after the change takes effect means you accept the updated Terms.
These Terms are governed by the laws of South Africa, without limiting consumer protections that apply where you live. We will first try to resolve disputes in good faith through the support contact below.
